These terms and conditions (the “Terms”) govern all prize draws or as otherwise referred to as ‘Drops’ (each a “Prize Draw”, together the “Prize Draws”) which take place on Unlock Your City website www.unlockyourcity.co.uk (“Website”).
The Promoter of the Prize Draws is British American Tobacco UK Limited, whose registered office is at Building 7, Chiswick Business Park, 566 Chiswick High Road, London, W4 5YG, United Kingdom (“Promoter”). By entering a Prize Draw, you are agreeing to be bound by these Terms.
Each Prize Draw is only open to entries from UK residents who are aged 18 and over, and who comply with all Terms.
The following are not eligible to participate:
employees of Promoter or of any British American Tobacco plc group company; or
employees or any other persons involved or assisting with the Prize Draw or otherwise professionally connected with the Prize Draw or their administration (including but not limited to, any person responsible for redemption of prizes or for supplying prizes for the Prize Draw).
The Website will include a countdown to the start of the ‘Drop’ Prize Draw (“Countdown Clock”). Each Prize Draw will open from the time the Countdown Clock reaches zero, at which point a ‘Drop’ clock will start counting down, and the Prize Draw will close when the ‘Drop’ clock reaches zero (the “Prize Draw Period”). Entries made outside of the Prize Draw Period will not be valid and will not be accepted.
To enter a Prize Draw, entrants must visit the Website, click the ‘Enter Drop’ button and complete the required fields (email, name and date of birth) and submit their entry by clicking on the ‘Enter Drop’ button again. Entrants will then be sent an email to verify their email address in order to enter the Prize Draw. Entries are limited to one entry per person per Prize Draw.
Promoter reserves the right to validate any entry and may ask for proof of identity and/or age at any point. Promoter accepts no liability for any delays to or prevention of an entrant from participating in the Prize Draw by exercising its right to validate the identity and/or contact information and/or age of an entrant.
All entries must be made directly by the person entering a relevant Prize Draw. Entries made using methods such as a computer macro, a script or the use of automated devices or processes are not allowed and all such entries will be disqualified. Promoter is not responsible for changes in entrants' contact information after entering a Prize Draw.
The number of prizes available and the prize particulars for each Prize Draw will be as notified on the Website (each a “Prize”, together the “Prizes”). Promoter reserves the right to replace any or part of a Prize with an alternative prize of equal or higher value if circumstances beyond Promoter's control makes it necessary to do so.
Unless otherwise specified on the Website, the Prize does not include any costs for travel, food and drink, spending money, tax or personal expenses and any other costs incurred in addition to those set out on the Website and any costs that are incidental to the Prize are the responsibility of the winner.
In most circumstances, the Prize will be tickets to a festival or event. It is the winner’s sole responsibility to ensure that they and any accompanying guests comply with all Covid-19 vaccination, testing and entry requirements in order to ensure entry to the festival or event. Entry to any festival or event will be at the discretion of the festival/event organiser. The Promoter accepts no responsibility for any refusal of entry due to a failure to comply with the festival/event organiser’s requirements.
There is no cash alternative and the Prize is not transferable or exchangeable. The winner is responsible for ensuring that they and any persons travelling with them are available to attend the festival/event on the specified on the Website and that they have complied with the entry requirements of the festival/event organiser.
The number of winners for each Prize Draw will be as specified on the Website. The winner or winners (as applicable) will be the first valid entry or entries (as applicable) selected at random from all valid entrants received during the Prize Draw Period. The draw will be made from all valid entries at random via a computer programme producing a verifiably random draw and will take place the week following the completion of each Prize Draw.
The winners will be notified via the email used to enter the Prize Draw with either a) the Prize included within the email via an attachment or link; or b) information on how to redeem their Prize in accordance with paragraph 14 (“Winner Notification Email”). Entrants who have entered the Prize Draw and have not won a Prize will receive an email notifying them that they have not won.
If the Winner received the Winner Notification Email requesting information on how to redeem their Prize, the winner will need to respond to the email sent by Promoter from the following email address firstname.lastname@example.org and provide the information requested which may include amongst other things, full name, email address, mobile number, a valid form of ID to verify date of birth to confirm that they are over 18 and/or a postal address in the UK of each person attending the event (“Information Request Email”). The winner will be allowed one (1) calendar day from the time of the Information Request Email to respond and provide the requested information (“Information Request Deadline”). It is the winner’s responsibility to check their emails carefully and regularly to ensure that they do not miss the Information Request Email, this includes checking junk or spam folders. The Information Request Email will then set out how their tickets will be sent to them or redeemed once they have successfully responded to the Information Request Email within the Information Request Deadline.
If any of the following occur: a) the winner does not respond to the Information Request Email with the correct required information within the Information Request Deadline; or b) if any of the required information is incomplete or incorrect; or c) if the winner’s age, or that of the rest of the party attending the event, is unable to be verified or is under 18 (for events where the winner’s age needs to be verified), then the winner shall forfeit their Prize and Promoter shall be entitled to award the Prize to an alternative winner via another Prize Draw in accordance with the same process as the original Prize Draw. If the alternative winner does not reply within one (1) calendar day of receipt of the email, a new winner will be drawn in accordance with the above process, and this process will be repeated until an alternative winner has been allocated.
The Prize will be sent either via email, post to the address provided in accordance with paragraph 14, or unique code following the winner correctly addressing the steps set out in paragraph 13 and 14.
Promoter reserves the right to review, edit, alter or remove any entry in its sole discretion, which does not comply with these Terms or which it reasonably believes does not comply with these Terms.
Promoter reserves the right to exclude any entries which it believes to be fraudulent or based on misconduct, or if, in its reasonable opinion, it considers that there is a significant risk that the entrant may bring the Promoter or any other British American Tobacco plc group company brands or its partners into disrepute.
Promoter reserves the right to amend, terminate or temporarily suspend each Prize Draw if, in its absolute discretion, it considers it necessary to do so. Promoter shall not exercise this right unreasonably.
No responsibility will be accepted by Promoter for incomplete, invalid or illegible entries and these will be declared void in the sole discretion of Promoter.
The Prize Draws are not endorsed, sponsored, or administered by or associated with any of the brands, companies or events/festivals featured in the Prizes.
Promoter will not be liable for any internet or mobile connection or other charges incurred in entering the Prize Draw or in a winner using or enjoying a Prize. If using a computer or any other device and/or internet-access which is not owned or paid for by the entrant, the entrant is reminded to get the owner's permission before entering.
Promoter does not guarantee continuous uninterrupted access to the Website at any time. It is possible that numerous factors outside the control of Promoter may interfere with the operation of the Website. No responsibility will be accepted for any technical or other difficulties in entering or any entries delayed or corrupted.
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up a Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
Any enquiries about personal information held by Promoter, including any request for deletion of personal data, may be made by contacting email@example.com, to obtain the contact name and address to which to send an envelope marked "Data Protection Request".
Promoter must either make available information that indicates that a valid award under the Prize Draw took place and so Promoter will send the surname and county of all of the winner of the Prize Draw to anyone who contacts Promoter using the details in paragraph 28 requesting such information within one month of the date of the Prize Draw.
If you object to any or all of your surname or county being made available, please contact Promoter via firstname.lastname@example.org. In such circumstances though Promoter must still provide the information and winning entries to the Advertising Standards Authority upon request.
These Terms shall be exclusively governed by and construed in accordance with the laws of England and the English Courts will have exclusive jurisdiction in the event of any dispute.
